STANDARD TERMS AND CONDITIONS FOR THE SUPPLY OF SERVICES
As all animals, dogs and their behaviours naturally change over time due to factors such as age, health, diet and changes in their environment.
1. Definitions
In this document the following words shall have the following meanings:
a. ‘Client’ means the individual who requested the work
b. ‘Supplier’ means Ibex Canine Training & Behaviour, its associates, employees, related entities and officers.
c. ‘Terms and Conditions’ means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the Supplier.
2. General
a. These Terms and Conditions shall apply for all supply of Services by the Supplier to the Client and shall prevail over any other documentation or communication from the Client. Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Supplier.
b. By booking one of the Supplier’s services, the Client is agreeing to these Terms and Conditions.
3. General Conditions
a. The Supplier reserves the right to refuse service to anyone for any reason at any time.
b. The Client understands that their content (not including credit card information), may be transferred unencrypted and involve:
a. transmissions over various networks; and
b. changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
c. The Client agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or material provided without express written permission by the Supplier.
4. Supplier’s Property
All material provided or prepared by the Supplier, both text and images included in documents, are the sole property of the Supplier and may not be reproduced in any form in part or whole without the written consent of the Supplier.
5. Cancellations
a. The Supplier reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause.
b. By booking the Client will agree to keep the date and time of the consultations. The Client ackowledges that the deposit paid at the time of the booking is non refundable under any circumstances and will be adjusted against the total cost of the session.
c. In case of packages, once booked and paid for, there is no refund available to the Client under any circumstances.
6. Limitation of Liability and Disclaimer
a. The Supplier shall not be liable for any direct, indirect or consequential loss, injury or damage suffered by the Client or any third party however so caused as a result of negligence, breach of contract or otherwise in excess of the price of the Services or products.
b. Any information provided by the Supplier is general in nature based on the Supplier’s personal views and information given to the Supplier by the Client. The Client should consider whether the information is appropriate to their needs. The Supplier advises Clients to contact their veterinary specialist implementing any information suggested by the Supplier. The Client accepts full responsibility for determining whether the Services are suitable for any particular purpose and for protecting themselves and their animal against any consequential damage.
c. The Client remains responsible for their dogs at all times and are advised to ensure they have adequate pet or household insurance cover for liability in the unlikely event of damages or injury caused by or to their dogs, to property or to a third party.
d. The Client expressly agrees that their use of, or inability to use, the service is at their sole risk. The Service and all products and services delivered to the Client through the service are provided 'as is' and 'as available' for the Client’s use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
e. The Supplier does not guarantee the success of any treatment plans suggested. Treatment plan success depends on the animal’s history and environmental circumstances outside of the control of the Supplier. Successful outcomes requires a good deal of patience. As each animal is an individual case, and it is not possible to foresee if another problem may arise as a result of the treatment, results cannot be guaranteed. All programs are specific to a certain animal and should not be tried on any other pet, only the animal whose name that appears on the information provided by the Client.
Media including but not limited to videos and pictures taken during sessions can and may be used by the supplier in any shape or form and the client releases any liability related to this. These may be uses may be but not limited to marketing, education, learning and development and the client may not assert a claim on these.
